Brightech provides cloud consulting, software development, and technology services specializing in AWS solutions, healthcare, and government sectors. Our services include but are not limited to:
- CTO-as-a-Service and technology leadership
- Custom software development and application modernization
- AWS cloud migration and optimization
- DevOps implementation and support
- HIPAA-compliant solution architecture
3. User Responsibilities
You agree to:
- Provide accurate and complete information when engaging our services
- Maintain the confidentiality of any account credentials
- Use our services in compliance with all applicable laws and regulations
- Not interfere with or disrupt our services or servers
- Not attempt to gain unauthorized access to any systems or data
4. Intellectual Property Rights
All content, trademarks, service marks, logos, and intellectual property displayed on this website are the property of Brightech or our licensors. You may not use, reproduce, or distribute any content without our prior written permission.
Work product created specifically for clients under service agreements will be governed by the intellectual property provisions in those agreements.
5. Confidentiality
We respect the confidential nature of client information and maintain strict confidentiality protocols. Any confidential information shared during the course of our engagement will be protected in accordance with industry best practices and applicable agreements.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIGHTECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising out of or relating to these terms or our services shall not exceed the amount paid by you to Brightech in the twelve (12) months preceding the claim.
7. Indemnification
You agree to indemnify, defend, and hold harmless Brightech, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of our services or violation of these terms.
8. HIPAA Compliance
For healthcare-related services, we maintain HIPAA compliance and will enter into Business Associate Agreements (BAAs) as required. All protected health information (PHI) will be handled in accordance with HIPAA regulations.
9. Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of North Carolina.
10. Dispute Resolution
We prefer to resolve disputes amicably. Before initiating any legal proceedings, parties agree to attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
11. Modifications
We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting on this website. Your continued use of our services after any modifications indicates your acceptance of the updated terms.
12. Severability
If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
